Terms and Conditions

These Terms and Conditions form an agreement between you and The Bertram Bunch Pty Ltd, trading as Wazzumi (“Wazzumi”, “we”, “us” or “our”), concerning your use of wazzumi.com, its progressive web app and related services (the “Service”). By creating an account, purchasing a subscription or using the Service, you agree to these Terms and our Privacy Policy.
Eligibility and accounts
You must be at least 18 years old and legally able to enter this agreement. You must provide accurate account information, protect your password and promptly tell us if you suspect unauthorised access. You are responsible for activity performed through your account unless caused by our failure to use reasonable care.
One person should not use another person’s account. We may suspend or close accounts used fraudulently, unlawfully or in serious breach of these Terms.
Health information and important disclaimer
Wazzumi is a self-management, tracking and planning tool. It does not provide medical advice, diagnosis, treatment, emergency assistance or a substitute for a qualified health professional. Calculations such as BMI, BMR, calorie expenditure, deficits, weight projections and nutrient estimates are approximations and may not be suitable for your circumstances.
You remain responsible for the targets you choose and decisions you make. Weight-loss rates, calorie targets, fasting patterns and exercise plans can carry risks. Seek professional advice before making significant dietary or exercise changes, particularly if you are pregnant, under medical care, taking medication or have a history of disordered eating. Do not use Wazzumi for an emergency.
AI-generated content
Wazzumi Plus may generate recipes, ingredients, nutrition estimates and instructions using artificial intelligence. AI output can be incomplete, inaccurate or unsuitable. You must review quantities, allergens, food safety, cooking temperatures, dietary restrictions and nutritional values before relying on or sharing it. AI output is not professional health or dietary advice, and we do not guarantee that a generated recipe will meet every requested target.
Your content and data
You retain ownership of information and original content you enter. You give us a limited licence to host, process, reproduce and transmit that content only as needed to operate, secure and improve the Service and provide features you request. You must have the right to submit the content and must not upload unlawful, malicious or rights-infringing material.
You can delete your account in Settings. Account deletion is intended to permanently remove data associated with the account from our active application database, subject to legal obligations, security records, payment records and limited backup retention described in our Privacy Policy. Cancel any subscription before or as part of account deletion.
Free and paid services
Wazzumi may offer free features and paid Wazzumi Plus features. We may add, remove or change features, usage limits and plan availability. Material changes affecting an active paid subscription will be communicated where reasonably practicable and as required by law.
Subscriptions and automatic renewal
Monthly and annual subscriptions are billed in advance through our payment provider and renew automatically for the same billing interval until cancelled. The price and billing interval are shown before checkout. By subscribing, you authorise recurring charges to your selected payment method.
You can cancel through the billing controls in Settings. Cancellation stops future renewals; paid access ordinarily continues until the end of the current billing period. Deleting the app, ceasing use or losing access to an email account does not by itself cancel a subscription.
Prices, payment failures and taxes
Prices may change. A changed price will not be applied to a renewal without any notice required by law. Applicable taxes may be included or added as displayed at checkout. If payment fails, we or our payment provider may retry payment, restrict paid features or cancel the subscription.
Refunds
Subscription charges are non-refundable and we do not provide credits or prorated refunds for an unused portion of a billing period merely because you cancel or stop using the Service. This does not exclude any refund, replacement, re-performance or other remedy you are entitled to under the Australian Consumer Law or another law that cannot lawfully be excluded.
Acceptable use
You must not use the Service to break the law; harm, harass or impersonate another person; submit deceptive information; infringe intellectual property or privacy rights; distribute malware; probe or bypass security; scrape or overload the Service; reverse engineer protected parts of the Service except where law permits; or use automated access in a way we have not authorised.
Third-party services and content
The Service relies on third parties including hosting, database, email, payment and AI providers. It may contain food datasets, links or other third-party material. Their availability and accuracy are not entirely within our control, and third-party services may be governed by their own terms and privacy policies.
Availability, changes and backups
We aim to provide a reliable Service but do not promise uninterrupted or error-free availability. Maintenance, security events, internet failures and supplier outages may interrupt access. Keep any independent records you cannot afford to lose. We may modify or discontinue all or part of the Service, but will handle active paid subscriptions consistently with applicable law.
Intellectual property
Except for your content and identified third-party materials, Wazzumi and its software, design, branding and original content belong to us or our licensors. These Terms give you a personal, limited, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose.
Consumer guarantees and liability
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot legally be excluded, including under the Australian Consumer Law. To the extent permitted by law, we exclude implied terms that may otherwise apply and are not liable for indirect or consequential loss, loss of opportunity, or loss arising from decisions based on estimates or AI output. Where liability for a service can lawfully be limited, our liability is limited, at our option, to supplying the service again or paying the reasonable cost of having it supplied again.
Suspension and termination
You may stop using Wazzumi and delete your account at any time. We may suspend or terminate access where reasonably necessary for security, non-payment, unlawful conduct or a material breach. Provisions concerning payments already due, intellectual property, disclaimers and liability survive termination where their nature requires it.
Changes to these Terms
We may update these Terms as the Service or law changes. We will publish the revised effective date and provide additional notice for material changes where appropriate. Continuing to use the Service after revised Terms take effect constitutes acceptance, except where law requires another form of consent.
Governing law
These Terms are governed by the laws of Victoria, Australia. You and Wazzumi submit to the courts of Victoria and courts entitled to hear appeals from them, without limiting any right you have to bring a claim in another forum under applicable consumer law.
